  1. Special Enquiries Cell was created vide Go No. 2407 / II-GA-512(4)73, dated 8.5.73 under the charge of DIG, OSD, as part of D.G.P, U.P, Head Quarters.

  1. Main thrust of this organisation is to monitor atrocities cases on SCs/STs as enumerated in Untouchability Offences Act 1955. Which was enlarged to cover many more offences in 1976, and it was titled as Protection of Civil Rights Act 1955. After amendment of this Act in 1976, it was felt that this organisation should be headed by an officer of the rank of Inspector General of Police to cope up with the problems and the tasks assigned to this organisation by the State Govt. Accordingly, the post of Inspector General of Police was created by Govt. order No. 1574 / VIII-PS-2-83 dated 5.5.83.

  1. The SC/ST (Prevention of Atrocities) Act 1989 was notified on 12 September, 1989 and subsequently rules under this were made on 31.1.1995 which were duly accepted by the State Govt. of U.P. vide order No. 6736KHA / VI-4-95-661 G / TC dated 27.9.95.

  1. This Act has more stringent provisions than the earlier laws on the subject, and Act and Rules internally provide for Identification of Atrocity Prone Areas and preventive actions to be taken in such areas.

  1. Rule-8 provides for establishment of a Monitoring Cell under the charge of Director General of Police/ Inspector General of Police. Duties of the Cell are enumerated under this rule.

  1. Special Enquiries Cell is headed by Addl. Director General of police w.e.f. 22.4.95 and he is assisted by IG-1, DIG-1, SP-1, Addl. SP-2 and Dy.SP-9.

Functions Performed by Special Enquiries Cell

  1. The Special Enquiries Cell is assigned the following Functions :

·         Action on applications received from members of SC/ST against non SC/ST persons.

·         To ensure prompt investigation of cases registered by members of SC/ST against non SC/ST persons.

·         To ensure protection of members of S.C. /S.T.

·         To ensure prompt action on complaints of unauthorised possession of land belonging to members of SC/ST.

·         To enquire into news-items pertaining to Atrocities on SC/ST.

·         To ensure action against Government Servants who neglect the interest of the members of SC/ST.

·         To ensure that victims of Atrocities are given monetary help promptly.

Special Enquiries Cell in Districts of U.P

  1. Special Enquiries Cells have also been sanctioned vide Go No.7657 / VIII-1-150-(13) / 86 dated 27.2.86 in twenty, more sensitive districts of U.P i.e. Lucknow, Hardoi, Sitapur, Raibarelly, Moradabad, Gonda, Bahraich, Sultanpur, Barabanki, Fatehgarh, Etawah, Banda, Jalaun, Basti, Gorakhpur, Azamgarh, Budaun, Meerut, Varanasi, Agra. In all the remaining districts, similar Cells are functioning from District Police Resources. District Cells are managed by 1 S.I., 1 H.C., 2 Constables, who perform assigned duties of the district cell and keep records pertaining to the problems of SC/ST's.

Special Court in U.P.

9.      Special Court have been sanctioned vide GO. No. VO-129/VIII-NAYA-9 (BUDGET)-97-4(SND)-97 Samaj Kalyan Anubhag-3 dated 8.9.97 and High Court Notification dated 17.8.98, in twenty districts of the State i.e. Fatehgarh, Unnao, Basti, Banda, Etawah, Hamirpur, Gonda, Kanpurnagar, Badaun, Sultanpur, Barabanki, Bulandshahr, Gorakhpur, Varanasi, Pilibhit, Etah, Deoria, Jhansi, Faizabad, Agra, and also twenty other Special Courts vide GO. No. 538/VII-NAYA-2-2001-124/89 dated 24.5.2001in Districts. Kanpur Dehat, Bahraich, Lucknow, Jalaun, Meerut, Ghaziabad, Siddharthanagar, Mizrapur, Chandauli, Balrampur, Fatehpur, Ghazipur, Mainpuri, Kannauj, Hardoi, Gautambuddhanagar, Shrawasti, Bagpat, Bareilly, Jyotibaphulenagar (total 40) for speedy trial of offences.

                     In addition to Special Courts, trials relating to matters dealt by the Special Enquiry Cell are also tried in 71 Fast Track Court operating in  the following 56 Districts i.e. Agra, Aligarh, Allahabad, Auraiya, Azamgarh, Ballia, Banda, Barabanki, Bareilly, Basti, Sant Ravidasnagar, Bijnor, Bulandshahr, Chitrakoot, Deoria, Faizabad, Farrukhabad, Fatehpur, Firozabad, Ghaziabad, Ghazipur, Gonda, Gorakhpur, Hamipur, Hardoi, Hathras, Jalaun, Jaunpur, Jhansi, Kanpur Dehat, Kanpurnagar, Kheri, Lucknow, Maharajganj, Mahoba, Mainpuri, Mathura, Mau, Meerut, Muzuffarnagar, Pratapgarh. Raibareilly, Rampur, Saharanpur, Shahjahanpur, Siddharthanagar, Sitapur, Sonbhadra, Sultanpur, Unnao, Badaun, Etah, Etawah, Kushinagar, Pilibhit, Varanasi. (Sanctioned vide GO. Please Note: Special Enquiries U.P, Lucknow deals only with complaints of the persons belonging to the SC/ST where the opposite party is non SC/ST.

 

 

Conclusion

The Special Enquiry Cell has played a leading role in by ensuring redressal of grievances of members of SC/ST during the post 26 years of its existence. A large number of applications are received in person and through post, pertaining to atrocities against members of SC/ST, which are enquired into by the officers of this cell or by District Police Officers under supervision of this cell. To ensure efficacy and promptness of redressal, Govt./Departmental orders have been issued from time to time.

Besides active follow-up of complaints, the Cell brings out regular publications and undertakes capacity-building activities for the guidance of officers and organisations engaged in the welfare of memebers of the Scheduled Castes and Scheduled Tribes.
